No if tested positive in September 09 then he should have been suspended last year and removed from the AP poll last year. They shouldn't have waited until last week to do something about it.

no way you know what he tested positive for? Brian Cushing tested positive for slightly elevated levels of hCG (a non-steroidal substance produced naturally by the body). it is in seminal fluid and slightly elevated levels can be discovered in the event that a test occurs soon after ejaculation. he could have gotten his rod sucked in the waiting room of the testing facility. its a known chemical when on roid cycles and may be cause enough to test for other things but damn something that is produced naturally by the body is no way concrete enough
