The Cowboys might not take the NFL's cap penalty sitting down after all. An unnamed source told NBCSports.com's Mike Florio that the Cowboys and Redskins could be preparing to go "nuclear" on the NFL after the league instituted cap penalties on both teams just before the start of free agency. The penalties were in response to the way each club structured contracts during the 2010 uncapped season. "The two teams are contemplating suing anyone and everyone connected to the sudden removal of $46 million in total cap space over the next two years, based on the contention that their treatment of the term 'uncapped year' too literally somehow created a competitive disadvantage," Florio wrote. It's not exactly rocket science, it's just that the other teams didn't abuse it while Washington and Dallas did ignoring several warnings by the NFL. You can't complain (well you can) afterwards and cry poor me. Those 2 said F it thinking the NFL was bluffing, they weren't.
From what I was reading the issue isn't so much with what they did with the contracts they made this year, it was ones that were from the past in which they dumped money from contracts that should have had ramifications in future years into the uncapped year (aka all the money the Redskins owed to Haynesworth).

Wow how do people not see this its simple. The league approves all contracts. They approved these contracts. The league allowed an uncapped year. These teams had no obligation to NOT front load contracts in the uncapped year. They did so because they took advantage of a flaw and the NFL flipped crap about it. The NFL has no legal backing to take away cap space for their mistakes. The warnings were bullcrap they are invalid. The league had no right to demand teams not take advantage of their stupid flaw. Boltz is right, its not rocket science.
It was "warnings" on a "rule" that was never part of the CBA and never in writing. In other words...it wasn't a rule and it was a problem from the get go. You can complain when the NFL is the one that approves all contracts and those contracts in question were approved by the same league that is punishing the two teams.
A lawsuit should settle that then, but let's not pretend that this came out of nowhere and that these 2 were so much smarter than the rest of the league and now are getting punished by the rest for being so smart. They simply just took the risk that the NFL wouldn't do anything about it.
don't see what the problem is. Guess it was like a gentlemen's agreement not to do that so teams could outprice the smaller market teams. But there was nothing in writing so the League is on thin ice. Smart move on the teams. Why not take advantage of the rules.
