Seahawks backup quarterback Josh Portis will be arraigned May 28 for driving while intoxicated, after being arrested on May 5.

Portis was pulled over at 9:26 p.m. on May 5 after he was observed driving 80 miles an hour in a 60-mile-an-hour zone exiting the Mount Baker Tunnel on eastbound I-90 in a 2008 Range Rover.

A report from the Washington State Patrol says the officer noticed “a strong odor of intoxicants coming from the vehicleâ€￾ and that the driver “had watery bloodshoot eyes.â€￾

Portis later submitted to two blood tests and registered blood alcohol concentration readings of .092 and .078. The legal limit in the state of Washington is .080. He was charged with a gross misdemeanor.

The arraignment will be in the Redmond Courthouse.

    What a Joke

One test was under the limit and the other barely above. At those levels, there's no way this caused the "bloodshot" eyes the cop claims to have seen. Any decent attorney should get him off since both tests did not confirm he was over the limit. Who's to say the lower reading wasn't correct?

The article said "Later" he took those tests so earlier his levels could have been a lot higher, either way..screw those Hawk players.

I have bloodshot eyes from time to time. Sometimes I'm freaking tired. I don't know if I ever get 'watery, bloodshot eyes' because I had one too many beers.

I agree with lady, this crap should get thrown out. Two tests and one showed he was under.

Yeah because NFL players never do anything else that has a reputation for causing inebriation and red bloodshot eyes when they are out partying.

As I've said before many times, and will surely say again many more, BAC levels don't mean crap. If you have alcohol in your system and the arresting officer feels that you are inebriated, you WILL get a DUI regardless of your BAC. BAC is far too subjective to use as an absolute definition of drunkenness. A 95 pound college chick who just started drinking recently blows a .08, she's more than likely crapfaced drunk. A 300lb dude in his forties thats been drinking almost daily for 20+ years blows a .08, he's probably dead sober. There's no way you can accurately judge inebriation by that alone.

Portis has already been released. the seahawks are sending a clear message to their players .......... "Alcohol is evil and will not be permitted. just stick with the adderall we provide you."
