I'd encourage people to look into libel/slander laws, they're pretty interesting to me and I studied them while I was in school.

Look up Hustler v. Falwell, thats a good one, and a benchmark case that established a lot of precedent that will come up in this issue.

Things get even trickier when public figures are involved because they basically have to have thicker skin being in the public eye all the time. I agree with the thought that if I'm Shockey and I'm innocent, probably make a statement to defend myself and drop it. I doubt highly anything fruitful comes from legal action in this case.
